The maritime distress of migrants and anthropogenic climate change are among the most pressing humanitarian and political challenges today. This paper explores whether the failure of states and supranational entities to address these issues constitutes extreme injustice from a legal ethical standpoint, referencing the Radbruch formula. It examines the minimum ethical obligations this situation imposes on states and communities of states. The author advocates for the development and application of relevant analyses and discourses as normative guidance. This approach emphasizes the need for applied legal philosophy not only in the context of migration and climate protection policies but also for lawmakers and public discourse. By framing these complex problems through a legal ethical lens, the paper seeks to illuminate the responsibilities of states in addressing the crises faced by migrants and the environment, urging a proactive stance in both legal and moral dimensions.
