Nach einer Darstellung der historischen Entwicklung des Mahnverfahrens sowie der gesetzgeberischen Intention folgt eine genaue Untersuchung von Rechtsgrundlagen und Umfang der Prüfungsbefugnis des Rechtspflegers. Im Ergebnis ist der Rechtspfleger zu einer eingeschränkten Sachprüfung berechtigt und verpflichtet.
