In den weniger als vierzig Jahren seit der Einführung des Insolvenzrechts hat sich China wirtschaftlich rasant entwickelt. Der Gesetzgeber hat zwar viel zur Verbesserung des Insolvenzrechts beigetragen, doch aus der Praxis ergeben sich weiterhin zahlreiche Fragen. So existiert in der VR China kein Verbraucherinsolvenzverfahren, was bedeutet, dass Gläubigerforderungen bei Überschuldung eines Verbrauchers nur durch zivilrechtliche Vollstreckung erfüllt werden können. Im Gegensatz dazu sind die Vorschriften der deutschen Insolvenzordnung, die sich über einhundert Jahre entwickelt haben, praktikabel und umfassend. Diese Untersuchung analysiert und vergleicht schrittweise das chinesische und das deutsche Insolvenzverfahren, um die Unterschiede aufzuzeigen. Einige Begriffe des deutschen Insolvenzrechts, wie der Insolvenzverwalter, wurden zwar in die chinesische Insolvenzordnung übernommen, jedoch bedeutet dies nicht, dass das chinesische Insolvenzrecht das deutsche vollständig kopiert. Zudem hat die Insolvenztheorie aus den USA großen Einfluss auf die Forschung.
