Freedom of Movement and Rights of Residence

This open access book explores the implications of Brexit on European citizenship through the lens of functionalist theory. Brexit represents a significant shift in what has been regarded as a key achievement of EU integration: Citizenship of the Union. It marks the first instance of an automatic and collective lapse of citizenship status, resulting in an involuntary loss for EU citizens of British nationality. While this does not lead to statelessness and is likely permissible under international law, it does entail a reduction of rights for both former Union citizens and second country nationals in the UK, along with their family members. The book begins by outlining the status and rights associated with European citizenship. It then addresses the legal uncertainties faced by second country nationals and British citizens transitioning to post-European third country status. The functionalist theory is examined in detail, highlighting three key applications to Brexit. Subsequent chapters investigate the intentions behind Union citizenship, the rights that can be frozen, and the authority over the withdrawal of citizenship status. The findings indicate that while Member States can revoke Union citizenship, former Member States face limitations in stripping acquired territorial rights. The final chapter presents conclusions and policy recommendations.
