Der Einsatz verdeckt ermittelnder Personen beschäftigt schon seit geraumer Zeit immer wieder die höchstrichterliche Rechtsprechung. Es dürfte wohl kaum eine andere Ermittlungsmethode geben, in deren Dunstkreis ebenso viele kontroverse Diskussionen geführt werden. Um so erstaunlicher ist es, dass eine Klärung der grundlegenden Probleme im Zusammenhang mit diesen Ermittlungsmethoden weiterhin in grosser Ferne erscheint. Erörtert werden in der höchstrichterlichen Rechtsprechung dabei zuvorderst Probleme, die sich erst im Laufe des Einsatzes der verdeckt ermittelnden Personen ergeben, wie etwa die Folgen des rechtsstaatswidrigen Einwirkens des Lockspitzels für die Strafbarkeit des Angelockten oder aber die Frage nach der Verwertbarkeit des Wissens der verdeckt ermittelnden Personen. Nur am Rande wird dabei jedoch auf das eigentlich vorgelagerte Problem der grundsätzlichen Zulässigkeit des Einsatzes verdeckt ermittelnder Personen eingegangen. Dabei kommt der Frage nach der Rechtmässigkeit des Einsatzes verdeckt ermittelnder Personen insbesondere deshalb erhebliche Bedeutung zu, weil derartige Ermittlungsmethoden als Eckpfeiler der Bekämpfung der Organisierten Kriminalität angesehen werden. In dieser Arbeit kommt der Autor zu dem Ergebnis, dass der Einsatz verdeckt ermittelnder Personen - mit Ausnahme der verdeckten Ermittler und Informanten - mangels hinreichender gesetzlicher Ermächtigungsgrundlage rechtswidrig ist und ein Einsatz derartiger Ermittlungsmethoden auch für eine Übergangsfrist nicht mehr geduldet werden kann. Hieran schliesst sich ein ausführlicher, umfassend begründeter Gesetzgebungsvorschlag an. Die Dringlichkeit einer derartigen gesetzlichen Regelung zeigt sich dabei insbesondere an dem Umstand, dass Tendenzen dahingehend erkennbar werden, dass in der polizeilichen Praxis vermehrt auf die gesetzlich nicht geregelten Formen des Einsatzes verdeckt ermittelnder Personen zurückgegriffen wird.
