Focusing on the guidelines for determining the object of legal controversies, this paper emphasizes the importance of constitutional rights related to evidence and motivation in oral proceedings. It analyzes relevant doctrines and jurisprudence from Uruguay, Peru, and Spain to address challenges in defining the controversy's object and its implications for legal rights. The author proposes reforms to the General Organic Code of Proceedings (COGEP) and offers recommendations for academic institutions and legal scholars to enhance understanding and application of these concepts.
