The Chinese Belt and Road Initiative has produced a flurry of activities both in the countries of the South Caucasus and in Russia. While mostly analyzed through the lens of geo-politics and geo-economics, there is new research emerging that represents more sophisticated approaches from a variety of social science disciplines. This volume, based on the AESC Annual Convention in December 2020, collects a sample of critical voices to study the effects of infrastructure projects on local livelihoods, on sustainable and environmentally sound development, transparency, and inclusiveness.

Der nationale Strafprozess sieht sich der Herausforderung transnationaler Kriminalität gegenüber, da grenzüberschreitende Straftaten durch organisierte Kriminalität und Terrorismus ein dauerhaftes Problem darstellen. In Reaktion darauf haben viele Länder ihre Zusammenarbeit in der Strafverfolgung verstärkt. Dennoch bleibt der Strafprozess im liberalen Sinne darauf ausgerichtet, die Rechte der Beschuldigten vor dem Staat zu schützen. Dabei sind Einschränkungen der Beschuldigtenrechte nicht berücksichtigt, insbesondere wenn Beweismaterial aus dem Ausland beschafft werden muss, wo andere Regeln gelten. Die Untersuchung zeigt am Beispiel russischer organisierter Kriminalität, dass trotz der Unterschiede zwischen civil law und common law beide Rechtstraditionen ein gemeinsames Ziel verfolgen: die Verfahrensfairness zugunsten des Beschuldigten auch bei grenzüberschreitenden Fällen zu gewährleisten. Diese gemeinsame Basis bildet den menschenrechtlichen Anspruch auf ein faires Verfahren und bietet eine Grundlage, um Einschränkungen der Beschuldigtenrechte bei der Beweiserhebung im Ausland zu begegnen. In diesem Kontext wird ein Grundkonzept für ein transnationales Strafprozessrecht entwickelt.
